On August 31, 2021, the Wheeling Police Department conducted an 8-man raid to retrieve a flip phone and in the process arrested the individual (a Wheeling Inn employee) for being in possession of a marijuana roach. On August 3, 2022, this possession of controlled substance charge was dismissed. The Wheeling Police Department never sent the alleged marijuana roach to the West Virginia State Police Crime Lab for testing. However, they kept the charge pending since August 31, 2021, while creating a public nuisance action against the Wheeling Inn.

It didn't take long for Chief Schwertfeger to seize this opportunity, exploiting it to add another tally to his indictment against the Wheeling Inn.

Chief Shawn Schwertfeger's unrelenting mission to cause disturbances at the Wheeling Inn is mirrored by the officers under his command at the Wheeling Police Department, who consistently enabled the accommodation of highly intoxicated individuals at the establishment. Shockingly, these individuals often were so intoxicated that they relied on personal assistance to reach their rooms. On December 02, 2021, Wheeling Police officers stumbled upon an individual sleeping in their vehicle at the Wheeling Island Casino. Rather than addressing the situation appropriately, one of the officers instructed the individual to proceed to the Wheeling Inn. Accompanying them, an officer escorted the individual to the front desk, returned their car keys, and returned to their own vehicle. To their dismay, it quickly became evident that the individual was in such an extreme state of intoxication that they were utterly incapable of managing on their own. The officer then retraced their steps, reentered the establishment, and patiently waited for the individual to complete the registration process. Finally, the officer guided the inebriated individual to the elevator and escorted them all the way to their assigned room.
